Under Canadian Energy Regulator Act section 258, the Governor in Council may designate international power lines by order to require certificate-based regulation instead of permits. Any existing permit must be revoked within 45 days of permit issuance. Once designated, no new permits may be issued and all applications must be processed as certificate applications.

258 (1) The Governor in Council may, by order, (a) designate an international power line as an international power line that is to be constructed and operated in accordance with a certificate issued under section 262; and (b) revoke any permit issued in respect of the line. (2) No order may be made under subsection (1) in respect of a power line more than 45 days after the issuance of a permit in respect of the line. (3) If an order is made under subsection (1), (a) no permit is to be issued in respect of the power line; and (b) any application in respect of the line is to be dealt with as an application for a certificate.
