Offence and punishment

Section 311 of the Canadian Energy Regulator Act establishes criminal penalties for contravening authorization conditions, orders, or regulations. Indictment convictions carry fines up to $1 million and/or up to five years imprisonment; summary convictions carry fines up to $100,000 and/or up to one year imprisonment.

311 (1) Every person who contravenes section 297, a condition of an authorization imposed under subsection 298(9), an order made under section 310 or a provision of a regulation made under section 312 commits an offence and is liable (a) on conviction on indictment, to a fine of not more than $1,000,000 or to imprisonment for a term of not more than five years, or to both; or (b) on summary conviction, to a fine of not more than $100,000 or to imprisonment for a term of not more than one year, or to both. (2) Subsections 379(2) to (6) apply, with any modifications that the circumstances require, in respect of an offence under this section.
